How Are Personal Injury Settlements Calculated?

Personal injury settlements can be tricky to calculate. If you've never done this before, it's easy to make a mistake and miss out on compensation you're owed, so talk to a personal injury attorney in Long Island as soon as you can to make sure your claim includes everything it should. Calculating "Economic" Damages The first type of damages that you can claim in a personal injury case is reimbursement for all the expenses you've had. These are known as your "economic damages." One of the key expenses here is usually your medical bills. If you've been injured by someone's negligence, you should be reimbursed for all treatment that's related to that injury. You should also be reimbursed for any lost income you had because you weren't able to work. If you work a salaried job and had to use your personal days or sick days, you should be reimbursed for the value of those. If you work an hourly job, you should be reimbursed the wages you lost. If any of your property was damaged, such as a mobile phone or a car, you should be reimbursed for those things. And if you had to lay out extra expenses to deal with your injury, such as hiring childcare because you weren't able to take care of your children while you recovered, this should all be included in your economic damages. more Calculating "Non-Economic" Damages Next, you should be reimbursed for your pain and suffering, mental anguish, loss of enjoyment of life, and other things that are called in the law "non-economic damages." Most of the time, these are calculated either by multiplying the total of your economic damages by a number between one and five (depending on how bad your injuries were), or by assigning a specific dollar amount to each day you suffered and multiplying that by the number of days it took you to fully recover. Your lawyer will tell you the best method for calculating these damages and help you do it well. You'll need to be able to justify these numbers, so you will need things like therapy records, the testimony of family or workmates about your mental state, or possibly your own journal or diary entries. Calculating Punitive Damages & Comparative Negligence Most personal injury cases don't qualify for punitive damages, but your lawyer can tell you if yours might. These are designed to punish the responsible party, and they only apply in cases where someone was wildly reckless or deliberately tried to injure another person. Your lawyer will also help you calculate your degree of fault. Under New York law, your total damages will be reduced by the same percentage as your fault in the incident, so it's important to have a lawyer calculating your claim to make sure you don't miss out on anything more than necessary. For help in calculating your claim, call Miller, Montiel & Strano in Garden City, NY for a free consultation. We serve Long Island and all of Nassau County.

How Can Medical Records Strengthen Your Injury Claim?

If you've been injured due to someone else's negligence, you have the right to bring a claim to get compensation for what you've lost. One of the most important parts of your claim will be your medical records. Talk to an injury attorney in Long Island right away to get more detail details on your specific situation. By Linking the Injury to the Accident The first important role of your medical records is to show that the injuries you're suffering are connected to the accident. The sooner you visit a doctor after the accident, the clearer this link will be, and it will also help if your doctor has noted in the records that your injuries are consistent with the type of accident you suffered. Never delay getting medical care after an accident. If there's too long a delay, the other side and their insurance company may try to argue that your injuries are unrelated to the accident. more By Giving a Firm Number to Your Economic Losses In a personal injury claim, you'll be asking for compensation for your economic losses or damages. These damages need to be quantified with firm numbers, and your medical records will back up your bills and receipts for medical care and show what was provided to verify that your numbers are correct. Medical bills are often the biggest part of any personal injury claim, so it's crucial to get this right. By Boosting Your Non-Economic Losses Non-economic losses are sometimes referred to as "pain and suffering," and these losses are all difficult to calculate. Pain, mental anguish, loss of enjoyment of life, anxiety: how do you put a number on these things? The courts have found that the best way to deal with it is to calculate your non-economic losses as a percentage of your economic ones. The most common method of doing this is to tabulate all your economic losses and then multiply the total by a number between one and five. The more serious your injuries are and the harder your recovery, the higher that second number will be. Your medical records thus serve two important functions in boosting your total for non-economic losses. First, the higher your medical bills and the higher your economic losses, the bigger that first number, which you'll multiply by one, two, three, four, or five. Second, your medical records will show what you've actually undergone in terms of treatment and recovery. Your medical records will thus be an important way of deciding whether you multiply your economic damages by one, five, or a number in between. Your medical records are a key part of your personal injury claim, but they're not the only thing to consider. Talk to us today at Miller, Montiel & Strano in Garden City, NY for help with your claim. We serve Long Island and Nassau County and are committed to treating each client like a person: not like a number. .

What Are the Signs You Need to Contact a Lawyer After an Accident?

It's often a good idea to contact a lawyer after you've been in an accident, but there are also certain signs that you really need one. Here in New York, our insurance laws are such that, in most accidents, the individual's own insurance covers their losses and damages, regardless of fault. But there are times when you really require a Long Island accident attorney. Signs You Need a Long Island Accident Attorney 1. You're Severely Injured New York has a no-fault system for dealing with traffic accidents, which means that you can't bring a personal injury claim or lawsuit after most accidents. But there are some exceptions. The first is if you have economic damages of more than $50,000. The second exception is if you have sustained a particularly serious injury. These are actually quantified and include dismemberment or being significantly disfigured; losing an unborn baby; permanent loss of the use of any part of your body; bone fractures; a significant limitation to the use of any part of your body; or less permanent injury, if it keeps you from being able to do your daily life routine for at least 90 days of the 180 days immediately following the accident. Some of these descriptions are a bit subjective, so talk to a lawyer to get a better sense of whether your injuries qualify. more 2. The Insurance Company Denies Your Claim Whether you are bringing a claim to your insurance company or against the other driver, a denied claim could be a huge frustration. Insurance companies love to deny claims for spurious reasons, hoping that you'll get discouraged and just go away. A lawyer will fight on your side and push the insurance company to pay you what they owe. 3. You're Being Falsely Blamed If the other party suffered serious losses and can't get full compensation from their own insurance company, it's not inconceivable that they may falsely accuse you of being responsible for the accident. If that's happening, you need the help of a lawyer right away. Your lawyer will investigate the accident on your behalf and aggressively defend you. 4. There Are Multiple Parties Involved Even if there are multiple parties, so long as your losses and damages are not that serious, you'll have to turn to your own insurance company for coverage. But if you have significant losses and there are many parties involved, it can get tricky to work out who should be responsible. A lawyer can help you here. This might be especially important if the accident was caused by a large commercial vehicle, as these types of accidents tend to create very bad injuries and a lot of property damage because of the size of the vehicles involved. If there are several parties who have all been hurt and had substantial losses, it's important to be sure that your claim doesn't get lost in the shuffle. For help after a car accident, contact us now at Miller, Montiel & Strano in Garden City, NY for help anywhere in the New York City area.

What Are the First Legal Steps After a Serious Injury?

After you've suffered a serious injury, things can be confusing and difficult. Learning in advance what to do if this should happen can help you and your attorney build a strong and convincing case. A Long Island personal injury lawyer can help you at every step. Seek Medical Attention Immediately Get medical care as soon as possible. Not only does this keep you physically safe, but it also creates a record of your injuries, and, assuming you get help quickly, links your injuries clearly to the accident. If you wait too long to get help, the other side might try to argue that your injuries are from something else. You'll need your medical records for any legal claim, and be sure to follow all treatment plans and keep detailed records. more Document the Incident If You Can Gather evidence if you're able to with your injuries; but if you are too badly injured, don't stress. Ask a friend or family member to get evidence for you, or call a lawyer as soon as you can and get them on the case. You'll want to have photos of the scene, your injuries, and any property damage. You should also collect contact information from witnesses and, if applicable, get the police report. Report the Injury You'll want to notify all the appropriate parties, and who that party is will depend on the type of injury you've suffered. It might be an employer for workplace injuries, a property owner in slip-and-fall cases, or an insurance company for car accidents. When you make your report, keep it factual but avoid admitting fault. If you speak to an insurance company in particular, avoid giving many details or answering questions without your lawyer. Consult a Long Island Personal Injury Lawyer As soon as you're able, speak with a lawyer experienced in personal injury cases. A lawyer will talk through your situation and help you evaluate the strength of your case, explain your rights, and take you through each step of the actual legal process. Your lawyer will also protect you in negotiations and ensure you don't sign anything that isn't in your best interests. Be Careful of Early Settlement Offers Insurance companies sometimes like to offer quick settlements. They're often hoping to minimize payouts by convincing you to settle for a quick cash payment that's less than you deserve. Do not accept any offer or sign documents without consulting an attorney. Keep Detailed Records Be careful to track all your expenses that are related to the injury, and include not just the obvious ones, like medical bills, but also all your lost wages or salary records, and any other costs. It will also help if you're able to keep a journal documenting the way the injury has affected your daily life. Taking these steps will lay a strong foundation for your personal injury case. How Do You Determine the Value of a Personal Injury Case?

If you are involved in a personal injury case, it's good to be aware of how compensation may be calculated, and a personal injury attorney in Long Island, NY can help you correctly figure for everything you're owed. Actual Medical Expenses Medical bills are the foundation of any personal injury claim as they show the actual expenses incurred from an injury. This could include from emergency room visits, hospital stays, surgeries, medications, physical therapy or other forms of rehabilitation. The cost of transportation to and from medical appointments would also be included. more Projected Medical Expenses If an injury will likely require further medical treatment or long-term care, future medical costs could also be included in determining the value of the case. Medical experts will be called upon to help estimate the cost of future medical care in these cases. Reports from doctors and other medical professionals will help to prove the need for the ongoing care and justify the financial expense. Lost Income Since an injury can affect an individual's ability to work, records showing loss of income will help to determine the financial loss. Pay stubs and work records will be considered to calculate the financial loss from reduced hours or missing work entirely after the injury. Reduced Earning Capacity Sometimes, an injury means that someone is unable to perform their work duties due to their injury and must find another position or another job. Any reduction in income will be taken into account in determining compensation for a personal injury claim. Financial experts may be called upon to project the financial loss due to someone's reduced earning capacity. Pain and Suffering The value of a personal injury claim will also take into account the victim's physical pain, emotional distress, the loss of enjoyment of life, and other intangible losses. These fall under the category of non-economic damages, and in the state of New York are often calculated using the "multiplier method." The total amount of economic damages (like medical bills and lost wages) is multiplied by a number based on the severity of the injury and the impact on the victim's life. The Role of Liability New York is one of 13 U.S. states that are "pure comparative negligence" states. This means that even if a victim was partly at fault, they can still receive some compensation, no matter what their degree of fault is. Their compensation will be based on their fault. For example, if it is determined that they were 20 percent at fault, their compensation will be reduced by 20 percent. But even if their percentage of fault is as high as 80 percent, they can still recover 20 percent. Insurance Policy Limits and Defendant's Financial Situation Of course, the actual compensation received will be determined by how much the insurance policy can cover. If the compensation is being awarded in a personal injury lawsuit, the victim will not be able to get more from the defendant than they can financially provide. If you are involved in a personal injury case, reach out to the legal team at Miller, Montiel & Strano in Garden City, NY, for legal counsel and support in Long Island and the New York metro area.

What to Do After a Long Island Medical Procedure Goes Wrong

You think you might be the victim of medical malpractice, but you have no idea what to do next. One Harvard study showed that the medical institution only gets it right about 75% of the time, so there is a good chance that you will end up facing malpractice at some point in your life. The good news is it usually doesn't cause life-altering damage. For example, a doctor might well misdiagnose something minor, but your body might well correct the problem on its own. Yet when the medical institution gets it wrong and does damage you, such as by committing a major surgical error, you should have recourse. When malpractice does cause damage, there are steps that can help you if you end up pressing a case later. Talk to Your Doctor If you think something's gone wrong you can sometimes go to your doctor first and ask that they look into it and fix it. If it was their fault: for example, if they left a surgical sponge inside of you...then you might be able to get them to fix it at their own expense without defaulting to a lawsuit. If they refuse, you can use that refusal against them later. Being able to say: "I went to this doctor, I told them there was a problem, and they refused to do anything about it," can be very strong evidence in a medical malpractice case. Get a Second Opinion One of the key questions in your medical malpractice case will be whether the doctor lived up to the standard of care. You can help determine this by going to another doctor in the same field and having them examine you and go over what was done for you. If you think there was a straight up error you can get them to look for the error, too. This visit might help you discern whether you just got a negative outcome, which is an expected part of medical practice, or whether you have a true malpractice suit. Keep a Journal Documentation is important in any personal injury case. Keep a diary of: Medical costs, with bills and receipts. Pain and discomfort you feel. Conversations you have with medical professionals, what you said, what they said, and the outcome. Any other information that could be relevant to your case. This reduces the likelihood that you will forget information that is relevant to your case. Write the New York Medical Board You won't always hear back from the medical complaint board when you report an error, but it can impact whether the negligent doctor gets to continue practicing medicine if there is a long track record of complaints. In New York, you'll be reporting to the Office of Professional Medical Conduct (OPMC) and the Board for Professional Medical Conduct. The complaint must be in writing. Send them to: The New York State Department of Health Office of Professional Medical Conduct Riverview Center 150 Broadway, Suite 355 Albany, NY 12204 If you are complaining about a dentist, nurse, chiropractor, podiatrist, optometrist, or psychologist, send the complaint to: The New York State Education Department 1411 Broadway, Tenth Floor New York, NY 10018 Only final disciplinary actions are public information. Consult with a Medical Malpractice Attorney Bring all your evidence and sit down to discuss your case. We will tell you whether we think you have one that's strong enough to move forward. At times you might get an offer from an insurance company after you start taking some of these steps. Once you get an offer, stop and consult with us. That's a good signal that you have a case, and there's a good chance the offer is way too low. What You Need to Prove in Your Long Island Medical Malpractice Case

It's not easy to launch a successful medical malpractice suit. Only 42% of claims ever make it to settlement or trial. Thus it's important to know what you'd have to prove to make a successful claim. This will help guide you even before you choose an attorney, allowing you to understand what evidence you should be collecting. A Doctor-Patient Relationship Existed Before you can bring a medical malpractice suit, a doctor-patient relationship must exist. In general, a patient-physician relationship forms when the physician "affirmatively acts in a patient's case by examining, diagnosing, treating, or agreeing to do so." Once the physician acts in this fashion he has a duty of care towards the patient. If you never see the doctor and they never take any of these "affirmative actions" then a doctor-patient relationship does not typically exist. The Doctor Acted Negligently Doctors are considered to have acted negligently if they failed to uphold a reasonable standard of care. The standard of care is " a duty determined by a given set of circumstances that present in a particular patient. " It essentially asks whether any competent medical professional would have acted in the same way given the same patient, the same circumstances, and the same equipment.  It may also ask if the physician engaged in adequate communication with the patient to make a reasonable diagnosis, or whether the physician ordered appropriate testing. The Negligence Was the Cause of the Patient's Injury or Death If there's no actual loss, you don't have a case. There's also no case if there was a loss, but the loss was caused by something other than what the doctor did. This happens more often than you might think. A preexisting medical condition could rear its head and cause a problem, for example. It takes an experienced medical malpractice attorney to keep these sorts of case facts from muddying the waters and providing the doctor or hospital with a viable defense. The Injury Resulted in Compensable Damages If the injury is basically harmless there is no case. Yet if you had additional medical bills, lost wages, pain and suffering above and beyond what you would have suffered normally as a result of the injury or illness you presented with, mental anguish, scarring, disfigurement, disability or a loss of earning capacity then you can have those losses compensated with a medical malpractice suit. If the patient died, their loved ones can press a medical malpractice wrongful death suit to recover compensation for the expenses and loss of income created by the loss of their loved one, as well as for emotional losses. So, do you have a medical malpractice case? Despite this information, you shouldn't do guesswork about whether you have a case or not. Reach out to one of our lawyers to get a case review. If we decide you have a case, involving us early will make your case stronger. This is because it will give us a head start on securing evidence that might otherwise be difficult to locate.
